These Terms are an agreement between you and DEJAN SEO PTY LTD (ABN 77 151 340 420), 29/97 Creek Street, Brisbane City QLD 4000, Australia ("we", "us"). They cover DEJAN App at app.dejan.ai, formerly Auxy at app.auxy.com (the "Service").
You accept these Terms when you click Agree. If you do not agree, do not use the Service.
When we change these Terms, we will ask you to agree to the new version. We record which version you agreed to and when.
The Service is for business use only. You must be 18 or over. If you use the Service for a company or a client, you confirm that you have authority to accept these Terms for them.
Keep your login secure. Do not share your account or resell access to it. You are responsible for all activity on your account.

Actions in the Service use prepaid credits. The credit cost of each action follows the prices our providers charge us, and it can change without notice.
Credits spent on actions you start are final and are not refunded.
If you use your own API keys, you pay those providers directly and you are responsible for every charge on those keys.
The Service uses third-party providers, including Google, OpenAI and Anthropic. We are not responsible for their outages, errors or changes to their services or prices.
We do not guarantee rankings, traffic, AI visibility or any other result. Output from the Service, including AI-generated output, may be inaccurate or incomplete. You decide what to publish or change, and you are responsible for that decision.
You own the data you bring into the Service and the output you generate with it.
We use your data only to run the Service for you. We send the data needed for each action to the provider that performs it. We never sell your data. We never use your data to train AI models.
Our Privacy Policy explains how we handle personal information.
We own the Service, including its code, prompts, models and methods. These Terms give you the right to use the Service. They do not give you ownership of any part of it.
The Service is provided "as is" and "as available". To the fullest extent the law allows, we exclude all warranties, conditions and liability, whether in contract, tort (including negligence) or otherwise, including liability for indirect or consequential loss and for loss of profit, revenue, data or goodwill.
Some laws, including the Australian Consumer Law, give you rights that cannot be excluded. Nothing in these Terms excludes those rights. Where the law allows us to limit our liability for a failure to meet them, our liability is limited, at our choice, to supplying the affected service again or paying the cost of having it supplied again.
You will cover our losses and costs, including reasonable legal costs, from any claim by a third party caused by:

If we close your account because you broke these Terms, you lose any unused credits. If we close it for any other reason, we refund your unused credits.
These Terms are governed by the law of Queensland, Australia. Courts in Queensland have exclusive jurisdiction over any dispute about them.
If any part of these Terms cannot be enforced, the rest still applies. These Terms are the whole agreement between you and us about the Service. We are not liable for delays or failures caused by events outside our reasonable control.
